— Appeal by the defendant from a judgment of the County Court, Nassau County (O’Shaughnessy, J.), rendered May 3, 1985, convicting him of criminal possession of stolen property in the second degree, upon a jury verdict, and imposing sentence.
Ordered that the judgment is affirmed.
The trial court did not err in denying the defendant’s renewed motion for dismissal grounded on the People’s claimed violation of Penal Law § 450.10. The record indicates that the return of a television set and an iron to the store from which they were stolen was done in good faith (see, People v Angelo, 93 AD2d 264).…
