This action was brought by the plaintiff Jerome B. Rakers in his capacity as the Administrator of the Estates of Robert Rakers and Roberta Rakers, his deceased minor children. Robert Rakers was eight at the time of his death and Roberta Rakers was five years of age when she was killed. The action was brought for the alleged wrongful deaths of the two children. The plaintiff sought to recover damages against the Southern Railway Company for its negligent operation of a freight train and recovery was also sought from the Estate of Edmund Rakers, deceased, for…
