Plaintiff in error, Charles M. Kent, was indicted at the August term, 1882, of the district court of Lake county, for the murder of one Thomas Bennett. The crime was committed on the 4th of July, of the same year, in the city of Leadville, and was witnessed by several persons. Upon the trial, which took place in the month of November following, the prosecuting attorney did not confine the testimony to' the facts occurring at the time of the killing, but called witnesses who had knowledge of the facts and circumstances which led to the rencounter resulting in the tragedy mentioned.
