OPINION AND ORDER
ROBERT D. MORGAN, District Judge.
This cause is before the court upon defendant’s motion to dismiss the complaint.
The complaint, based upon the equal employment opportunities provisions of the Civil Rights Act of 1964, 42 U.S.C. 2000e et seq., alleges that plaintiff applied to defendant for employment as a factory worker on February 22,1966, and that she was then told by an agent of defendant that she would not be employed for the reason that defendant would employ men to the exclusion of women as factory workers so long as male applicants for such work were available. 1 that,…
