According to the allegations of the petition, P. Feingold received from the defendant a deed to lot 9 in block 8 of Biltmore Park, a subdivision of Lakeland, Florida, according to plat of said subdivision recorded in plat book 8, page 41, of the record of Polk County, Florida, which purported to evidence a transaction by which the petitioner purchased the lot described as above.
