This is an appeal from a judgment of the General Term of the Superior Court of the city of Mew York, affirming a judgment of the Special Term, after a trial before the court without a jury.

The plaintiff was the grantee in a deed of land on Seventy-seventh street, executed by the defendant Smith and wife, reciting a consideration of $105,000, in hand paid, dated April 30th, 1874, acknowledged on the first day of May, thereafter, and immediately recorded.
