Error to the District Court of El Paso County. At the May, A. D. 1895, term of -the district court of El Paso county, plaintiff in error was tried, convicted and sentenced for murder of the first degree. To review the proceedings of the district court he brings the case here upon error.

Before entering upon a consideration of the errors assigned by plaintiff in error, we will consider an alleged defect in the record to which our attention is directed by the attorney general. This relates to the bill of exceptions which has. been certified to this court. This bill was not signed until after the trial in the court below had been concluded and judgment rendered, and it is contended that it was then too late; hence we are asked to exclude the bill from consideration upon this review.
