This Cause came before the Court for final disposition during a non-jury trial in West Palm Beach, Florida, from January 8, 2007 through January 12, 2007. The Plaintiff, Vital Pharmaceuticals, Inc. (“VPX”), filed this action against Defendant, American Body Building Products (“ABB”), seeking an injunction and monetary damages for alleged violations of the Lanham Act, 15 U.S.C. § 1125(a), and unfair competition pursuant to Florida common law.
