This is an automatic appeal from a judgment of guilty on two counts of murder after trial before a jury.
Viewing the record in the light most favorable to the People, it discloses that on September 16, 1954, Mr. and Mrs. Banks were in their cabin at Sea Downs packing their belongings in preparation for a trip by Mrs. Banks to Ceylon. On September 17 a friend called to visit Mrs. Banks at 9 a. m. and received no response although Mrs. Banks’ automobile was at the cabin.
