A petition for a declaratory judgment was filed in the Probate Court of Summit county by Ithamar B. Hinman, Jr., administrator w. w. a. of the last will and testament of Ms father, in which the plamtiff alleged ‘ ‘ that a controversy has - arisen in regard to the construction to be placed upon * * * item three [of the will] respecting the right and capacity of the Executive Committee of the Communistic Party in the United States of America, located in the city of New York, state of New York, to take as beneficiary and devisee * * *.”
