The plaintiff, Scarsdale National Bank and Trust Company (“Scarsdale”), com menced this adversary proceeding against Jay L. Switzer, a Chapter 7 debtor, for the purpose of barring his discharge under 11 U.S.C. § 727(a)(3) and (5) or, in the alternative, for a determination that the debt owed by the debtor to Scarsdale is nondischargeable under 11 U.S.C. § 523(a)(2)(B).
