Appeal from a judgment of the Supreme Court at Special Term, entered November 9, 1978 in Albany County, which denied petitioner’s application, in a proceeding pursuant to CPLR article 78, seeking to annul a determination of the Commissioner of Education. Arthur J. Brewster was appointed Superintendent of Schools for the Little Falls City School District (the District) on April 10, 1974, and was given a three-year contract, terminating June 30, 1977.
