This is an action by the defendant in error, plaintiff below, against the plaintiffs in error, defendants below, upon an appeal bond executed by the plaintiff in error Witter as principal, with the plaintiff in error Calloway as surety. We will refer to the parties as they were in the trial court. Issues were joined and the case tried to the court without a jury, resulting in a judgment in favor of the plaintiff, from which the defendants have appealed.
