This is a legal malpractice action. Defendant/appellant, Gail Mathes (Mathes), appeals the order of the trial court denying her motion for summary judgment. 1

In the summer of 1992, Blake Weber (Weber) was fired from his job at Jefferson Pilot Insurance allegedly for attempting to hire an African-American woman. In the fall of 1992, Weber hired Mathes to represent him in an action against Jefferson Pilot for retaliatory discharge.
