Appeal by Hiram B. Swar, for the use of Levi Kline, from the decree of the Court of Common Pleas of Lebanon county, in the matter of the appropriation of the money arising from a judicial sale of the real estate of Adam Miller, junior. The material facts in this case are fully stated in the opinion of this Court. On the appeal to this court, the following error was assigned: The court erred in decreeing the money in court to be paid to Philip Shower, and in not decreeing it to the j udgment of Hiram B. Swar.

Swar, for the use of Levi Kline, from the decree of the Court of Common Pleas of Lebanon county, in the matter of the appropriation of the money arising from a judicial sale of the real estate of Adam Miller, junior, consisting of a lot of ground situate in.
