Haymond, Judge:
At the November Term, 1954, of the Circuit Court of Calhoun County, the defendant, Floyd I. Morris, was indicted for the murder of Charles D. Weekley in October, 1954, in that county. The first trial upon the indictment, which was held during the April Term, 1955, of the circuit court of that county, ended in a mistrial which resulted from the failure of the jury to agree upon a verdict.
