Farmers National Bank v. Green River Dairy, LLC

I dissent from the Court’s opinion because, although the Court has articulated a sound technical basis for its conclusion, I believe the legislative history of I.C. § 45-1802 dictates a different outcome. Perhaps my view of the Legislature’s action is somewhat influenced by having grown up in the cattle-feeding business. From that vantage point, the arguments advanced by the Respondents with respect to the legislative process are understandable, as they apparently were for the district judge, who presides in farm country.
