This was an action to recover damages for the alleged breach of a contract for the sale of one thousand bushels of oats. The plaintiff bought of the defendant one thousand bushels of merchantable oats, and paid for the same before delivery. At the date of the purchase, the oats were in stacks and ricks, and, by the terms of the contract, they were to be threshed out by the defendant, measured at the machine when threshed, and then delivered to the plaintiff.
