Following this court’s resolution of liability and damages in favor of plaintiff, defendant filed a Motion for Costs pursuant to Rule 68 of the United States Court of Federal Claims (RCFC 68). Plaintiff opposed the motion, and on February 18, 1997, filed an application for attorney fees and other expenses pursuant to the Equal Access to Justice Act (EAJA), 28 U.S.C. § 2412 (1994). For the reasons discussed herein, the court denies defendant’s Motion for Costs and partially grants plaintiffs EAJA application for fees in the amount of $50,205.16.
