1Opinion of the Court
The plaintiffs reside at Spout Springs, a railroad station 17 miles from Sanford, and the feme plaintiff, being in family way, had engaged the professional services of Dr. I. H. Lutterloh, a practicing physician at Sanford, to attend her in her approaching confinement, and he promised to come whenever he might be called for. On 2 May, 1905, about 11 p. m., the feme plaintiff felt the pains of labor coming on and caused the following telegram, addressed to Dr. Lutterloh at Sanford, to be delivered to the agent of the defendant at Spout Springs for immediate transmission, and paid the charges:…
