This case fell to me on regular assignment. The opinion prepared and submitted in pursuance thereof did not meet with the approval of a majority of the judges, and an opinion thereafter prepared and submitted by RAGLAND, J., has received a carrying vote insofar as it follows the majority opinion in State ex rel. Lashly v. Becker, 290 Mo. 560, 235 S.W. 1017 on the matters here in issue. Inasmuch as the reasons set forth in my opinion why the Lashly decision should be overruled necessarily apply with equal force to the majority opinion filed herein, from which I respectfully dissent, my opinion…
