It is conceded that plaintiff held a valid policy of insurance, issued by defendant, upon certain hotel property in Boone, Iowa; that in June, 1895, while said policy was in force,1 the insured property was to some extent damaged by fire; that the proofs of loss were duly *603furnished to defendant, and that no part of plaintiff’s damages has been paid.
