Action upon a policy of accident insurance. Respondent is the widow of William H. Martin, the.insured, whose death is alleged to have been the result of accident within the terms of such policy. Judgment below went for plaintiff, beneficiary, and defendant was granted an appeal to the Springfield Court of Appeals. There the judgment of the trial court was reversed for procedural errors and the cause was remanded. As it was deemed that the opinion of that court was in conflict with. Mullins v.
