KERNER, Circuit Judge.
This is an appeal from a judgment rendered on a verdict of guilty upon an indictment containing 13 counts. The indictment charged misappropriation of the funds of a bankrupt estate by the agent of the debtor in possession; that that agent knowingly and fraudulently unlawfully transferred property of the estate to two general creditors in preference to those creditors and to the damage of other general creditors; and that he made a false oath with respect to schedules and reports filed by him during the course of the proceedings.
