This case arises out of a lending relationship between plaintiffs, Paul and Karen Kerouac, and Numérica Savings Bank, FSB (“Numérica”), dating back to 1981. Sometime aftér -February, 1989, plaintiffs apparently defaulted on loans extended by Numér-ica. On October 10, 1991, Numérica was declared insolvent and the Federal Deposit Insurance Corporation (“FDIC”) was appointed as receiver. On that same day, plaintiffs filed a writ of summons in Hillsbor-ough County (New Hampshire) Superior Court, alleging that Numérica breached duties of good faith and fair dealing,…
