This is an appeal on questions of law from an order of the Common Pleas Court of Montgomery County vacating a prior order dismissing the case for want of prosecution.

Plaintiff’s action was an appeal from an order of the Industrial Commission of Ohio denying his claim to benefits for an alleged injury. The petition was filed on April 5, 1954. The defendant filed an answer on April 21, 1954, which was in the nature of a general denial.
