KRUEGER, Judge.
The offense is an assault with intent to murder and the punishment assessed is confinement in the state penitentiary for a term of two years.
The record reflects that on the night of January 7th, 1947, appellant shot Will Roberts with a 410 single barrel shotgun at close range. The State’s testimony shows that Will Roberts, *351the injured party, was standing at or near a bus stop talking to a party when appellant came up the street with the gun.
