This is an application to vacate so much of an order allowing a writ of certiorari as granted a stay of the execution of the respondent’s determination, dismissing the relator, as chief of the fire department, after trial had on charges duly made. The writ and stay were granted ex parte on the affidavits of the relator, his counsel, and of several newspaper reporters. The record of the trial was not presented to the court, nor is it before me on this application.
