— Affirming.

In this action for damages for personal injuries, brought by appellee, Nick Baxavenie, against the appellant, Interstate Coal Company, the jury returned a *173verdict in appellee’s favor for $1,000. From the judgment based thereon, this appeal is prosecuted.

Appellant owns a boundary of coal land in Knox County, Kentucky. In this land several openings had been made for the purpose of mining coal. From some of these openings coal was being shipped to the market. Appellee was injured in the Potato Patch opening, which was some…
