HENDERSON, Judge.

Appellant was convicted of theft of property over the value of $50, and given seven years in the penitentiary; hence this appeal.

Appellant made a motion to strike out the testimony of the State’s witness Angelo Zuchelli (prosecutor) on the ground that he had been drugged, and was oblivious of all that occurred between 3 o’clock p. m. on the day of the alleged theft until 8:30 o’clock p. m.; that on account of drugs administered to him in beer during said time he had completely lost his mind, and was helpless as a two-year-old child, and that he only regained his mind and…
