This cause is in this court on the motion of James N. Baker, the defendant in the lower court, for leave to appeal from a judgment of conviction and sentence entered by the trial court on March 25, 1958. The defendant did not perfect an appeal as of right from said judgment but, as a basis for the granting of his motion for leave to appeal, now makes five claims of error committed by the trial court, specifically:

“1. Applicant was not represented by a lawyer nor was he at any time advised of his constitutional rights to be represented by a lawyer.
