Burch, J.:

The action was one of ejectment and for rents and profits. Plaintiff is a widow, to whom the real estate was set apart as one-half in value of real estate belonging to her husband during the marriage relation, of which she had made no conveyance. Defendant is a lessee under a lease executed by the husband alone. An answer and an amended answer and cross petition were filed. Replies to the answers were filed. A demurrer to the reply to the original answer was overruled. A demurrer to certain defenses pleaded in the amended answer was…
