*235Background

This is an action to recover damages for personal injuries and wrongful death on behalf of the decedent, James E. Davis. The decedent was employed as a member of the New York City Council when he was, tragically, fatally shot by an assailant in City Hall’s Council Chambers on July 23, 2003. Plaintiff Thelma D.
