The object of this suit is to have decreed the legal title, held by the defendant, J. W. Shively, to block 11 in the *268city of Astoria, to be in the relators — to have the state patent to block 139, which was tide lands, and alleged to have been procured by fraudulent representations, from the state, by the said Shively, cancelled and annulled, and to compel a conveyance of the title held under the patent by the defendant Shively to the relators.
