Reversing.

The pleadings and stipulation of fact disclose that the Will B. Miller Company, Incorporated, entered into a contract with A. F. Stich on November 17, 1936, for the erection of a house on a tract of land described in the petition at a cost of $3,100 and on December 3, 1936, entered into another contract with Stich for the erection of twelve houses oi another tract of land at a cost of $2,850 per house.
