—Order, Supreme Court, New York County (Kleiman, J.), entered December 23,1982, denying defendants’ motion for summary judgment, unanimously reversed, on the law, the motion is granted and the complaint dismissed, with costs. In 1981 defendant Indian Realty Company (Indian) was a partnership, consisting of the two individual defendants Samuel Brause and Milton Brause, as well as Norman F. Levy.
