This was a proceeding by the commissioners of highways of the town of Mill Shoals, White county, to lay out a road for private and public use as authorized by section 54, chapter 121, Rev. Stat. A petition in due form of law was presented to the commissioners and after examination into the merits of the case the prayer of the petition was granted. It is not questioned that the proceedings of the commissioners from the time the petition was received until the granting of the prayer thereof were regular and in conformity with the requirements of the statute.
