TUTTLE, Chief Judge:

This is an appeal from judgment of conviction and sentence of appellant Gradsky on three counts of an indictment charging him and others with numerous counts of mail fraud, 1 fraud in the sale of securities, 2 and conspiracy to violate the two statutes. 3

Because of the disposition we make of the case, we deal with only three assignments of error: (1) insufficiency of the evidence to warrant submission of the cases to the jury;' (2) refusal of the trial court to grant motion for mistrial after the prosecuting officer allegedly “vouched” for the credibility of two…
