In a proceeding pursuant to CPLR article 75 to permanently stay arbitration of an uninsured motorist claim, GEICO Insurance *331Company appeals from an order of the Supreme Court, Kings County (I. Kramer, J.H.O.), dated September 12, 2000, which, in effect, granted the petition and stayed arbitration of the respondent Valentina Makerevich’s uninsured motorist claim against the petitioners.
Ordered that the order is reversed, on the law, with costs, the petition is denied, and the proceeding is dismissed.
