A number of courts have been faced with the issue presented here and the decisions are in conflict. For a comprehensive review of those decisions see Yardville Supply Co. v. Bd. of Review, Dep’t. of Labor, 536 A.2d 324 (N.J. Super. Ct. App. Div. 1988), reversed on appeal in Yardville Supply Co. v. Bd. of Review, Dep’t. of Labor, 554 A.2d 1337 (N.J. 1989). I am persuaded by the reasoning of the Minnesota Court of Appeals in Schnaare v. Five G’s Trucking, Inc., 400 N.W.2d 762 (Minn. Ct. App. 1987).
