The question presented is whether the defendant, a Virginia local school board, may be sued in this court for money damages under 42 U.S.C.A. § 1983 (West 2003) by virtue of the Eleventh Amendment. 1

The plaintiff, Earl F. Cole, a local newspaper reporter and publisher, contends in this suit that the defendant Buchanan County School Board (“the Board”) violated his rights under the First and Fourteenth Amendments by retaliating against him for publically criticizing the Board and its members.
