MUIR, District Judge.
On September 7, 1977, the above-captioned case was removed to this Court from the Court of Common Pleas of Lebanon County, Pennsylvania by Defendant Small Business Administration, an agency of the United States Government, pursuant to 28 U.S.C. § 1442. On October 25, 1977, the Small Business Administration filed a motion to dismiss the complaint dr in the alternative for summary judgment accompanied by a memorandum of law and an affidavit of Richard J.
