Appeal from an order of the Supreme Court (Ryan, Jr., J.), entered March 24, 1993 in Franklin County, which granted plaintiffs’ motion for partial summary judgment on the issue of liability.

At issue on this appeal is whether Supreme Court erred in granting summary judgment to plaintiffs on the issue of defendant’s liability for the injuries sustained by plaintiff Jill M. McGraw (hereinafter plaintiff).
