Plaintiff-Appellant, Sam Williams, Jr. (“Williams”), appeals from the district court’s summary judgment dismissal of his 42 U.S.C. § 1983 prisoner’s civil rights action. Williams alleges that his First, Eighth, and Fourteenth Amendment rights were violated by officials 1 (“defendants”) at the Alger Maximum Correctional Facility (the “Alger Facility”). The defendants moved for dismissal of the claim pursuant to Fed.R.Civ.P. 12(b)(6), failure to state a claim upon which relief can be granted.
