Dr. W.H. Pierson, a defendant herein, acting as the agent of the Commercial National Bank in Shreveport, Louisiana, trustee of the heirs of W.F. Johnson, deceased, entered into a verbal contract with J.S. Jones, also made defendant, whereby said Jones, for $495, agreed to re-roof a certain building in the City of Natchitoches, Louisiana, owned by said heirs and then occupied by plaintiff, West Brothers, as tenant of the owners.
