This is an appeal by defendant from an order of the court below making absolute a rule for judgment for want of a sufficient affidavit of defense and a rule to strike off defendant’s counter-claim. The action was assumpsit to recover the balance of the purchase price of certain building steel products furnished by plaintiff to defendant for use by it in installing electrical equipment on premises No. 1616 Walnut Street, Philadelphia, under a contract described in the statement of claim as “partly in writing and part oral” and consisting of a written order for the…
