The magistrate judge to whom this matter was referred has filed a report and recommendation (dkt. no. 14) with respect to the respondent’s Motion (dkt. no. 8) for Summary Judgment. Neither party has objected to the report. After carefully reviewing the pleadings, the parties’ motion papers, and the report and recommen*349dation itself, I adopt the report and recommendation of the magistrate.
Accordingly, I ADOPT the recommendation (dkt no. 14). Respondent’s Motion (dkt. no. 8) for Summary Judgment is GRANTED.
