PELL, Circuit Judge.

The defendant was charged in count one of a three count indictment 1 with distribution of a controlled substance in violation of 21 U.S.C. § 841(a)(1). Specifically, the defendant was charged with distributing 20 grams of a mixture containing heroin on November 9,1976. He was found guilty by a jury and was sentenced to five years in the custody of the Attorney General to be followed by the mandatory three year special parole term codified in 21 U.S.C. § 841(a)(1).
