Defendants Michael Lee Matthews and Robert G. Prater appeal from judgments entered in the United States District Court for the Northern District of New York, following a jury trial before Howard G. Munson, Judge, convicting each of them on one count of bank robbery, in violation of 18 U.S.C. §§ 2113(a) and (b) (1988), and one count of conspiracy to commit bank robbery, in violation of 18 U.S.C. § 371 (1988). Matthews was sentenced principally to 135 months’ imprisonment on the robbery count and 60 months’ imprisonment on the conspiracy count, to be served concurrently,…
