In an action to foreclose a mechanic’s lien, the defendant Sol Cafe Mfg. Corp. interposed a counterclaim against the plaintiff to recover damages for breach of contract dated September 17,1953, as modified on December 18, 1953, pursuant to which plaintiff was to construct a building according to the plans annexed to the contract.
